The Penal Code criminalizes the following: counterfeiting, forgery and alteration of metal coins and legal tender banknotes. Whoever is the author of it is punished with life imprisonment

Is punished with this same penalty any person who knowingly participates to the issuance, the distribution, the sale or the introduction into the national territory of counterfeit, falsified or altered of currencies having legal tender

The coloring of currencies having legal tender with the aim of deceiving on the nature of the metal or issues or introduces on the national territory of such colored money. Whoever the author of it is punished with imprisonment of six months to three years.

Is punished with the same penalty any person who participates to the coloring, the issuance or the introduction of the said currencies on the national territory

The re-circulation of counterfeit, falsified, altered or colored metallic coins or banknotes after having discovered their vice. The author incurs an imprisonment penalty of one to sixth months and a fine equal to four times the such put back into circulation amount.

The manufacturing, the issuance, the distribution, the sale or the introduction on the national territory of monetary signs intended to supplement or replace the currencies having legal tender. The author exposes himself to an imprisonment penalty of one to five years and to a fine of 500 to 20.000 dirhams

The manufacturing, the purchase, or the assignment of products or materials intended for the manufacturing, the counterfeiting or the falsification of currencies. The author incurs a penalty of imprisonment of two to five years and a fine of 250 to 5.000 dirhams without prejudice of aggravation of the penalty if the fact constitutes a more serious offence

The Dahir of 1956 prohibits and incriminates any non-authorized reproduction, exposure, diffusion, distribution or putting on sale of the picture of His Majesty the King whose effigy is systematically represented in the monetary signs, whether they are banknotes or coins

The Dahir of 1970 instituting the High Authority for the Control of the Symbols and Emblems of the Kingdom of Morocco frames and subjects to authorization the use of the said symbols and emblems, whose representation appears at the level of the monetary signs of Morocco.

The law n° 40-17 establishing the status of Bank Al-Maghrib exclusively authorizes this Institution for the purposes:

to issue coins and banknotes sole having legal tender on the national territory;

to fix the denominations, the formats, the vignettes and all the other artistic, technical and security characteristics of the banknotes;

to fix the denominations, the types, the natures, the weights, the dimensions, the tolerances and all the other characteristics of metal coins

to put and remove from circulation a type of banknote or metal currency. This decision of putting into circulation and remove is approved by decree made by the head of government published in the official bulletin of the kingdom of morocco;

to assess and maintain the quality of banknotes and coins in circulation

to punctually remove from circulation and to cancel the banknotes and coins no longer satisfying the conditions of monetary circulation (falsified, counterfeit, or presenting signs likely to enable fraudulent maneuvers or to damage the prestige of the national currency)

to proceed with the printing of banknotes and the minting of coins having legal tender on the national territory.

By its exclusive jurisdiction in matters of issuance, putting into circulation, maintenance and withdrawal of fiat currency, Bank Al-Maghrib can intervene in prevention of the risk that a reproduction of monetary signs having legal tender - even if were carried out in good faith – will be qualified as counterfeit currency or forgery criminally sanctioned.

By the intellectual rights it possesses on the artistic characteristics decided, designed and made by its own means in the framework of its fiduciary issuance privilege and its monopoly of production of Morocco’s monetary signs, Bank Al-Maghrib enjoys a permanent right of oversight on any reproduction of those signs for lawful purposes.
